(1) At any time, a shipmaster may unload cargo loaded in contravention of any statute or a contract and, when it is apprehended that the cargo may imperil a ship or other cargo, may give up such cargo.
(2) When a shipmaster transports cargo under paragraph (1), he/she may request the payment of the highest freight of the same type of cargo at the time and place of the loading.
(3) The provisions of paragraphs (1) and (2) shall not affect claims for damages of carriers and other interested persons.[This Article Wholly Amended by Act No. 8581, Aug. 3, 2007]
