(1) An obligee in inheritance, or a testamentary donee, or an obligee of an inheritor, may, within three months from the time of the commencement of the inheritance, apply to the court for the separation of the inherited property from the inherent property of the inheritor.
(2) An application may be filed with the court for the separation of property even after the period mentioned in paragraph (1) elapses, until such time as an inheritor has not accepted or renounced the pertinent inheritance. <Amended on Jan. 13, 1990>
