(1) A mail order distributor shall take measures necessary for the supply of goods, etc. within seven days from the date the consumer places an order, and in the case of a mail order for which the consumer pays all or part of the price of such goods, etc. before receiving them (hereinafter referred to as "prepaid mail order"), he or she shall take measures necessary for the supply of the goods, etc. within three business days from the date the consumer pays all or part of the price; provided, this shall not apply where a separate agreement is made between the two parties regarding when to supply.
(2) Where the supply of ordered goods, etc. is not available, a mail order distributor shall inform the consumer of the reason without delay, and in the case of a prepaid mail order, the distributor shall make a refund or take measures necessary for refund within three business days from the date the consumer pays all or part of the price.
(3) A mail order distributor shall take adequate measures so that consumers can confirm the procedures for and progress of the supply of goods, etc. In such cases, the Fair Trade Commission may determine and publicly notify matters necessary for such measures.
(4) Article 18(1) through (5) shall apply mutatis mutandis to refund or necessary measures for refund in connection with prepaid mail orders under paragraph (2).[This Article Wholly Amended on Feb. 17, 2012]
