Equal Employment Opportunity and Work-family Balance Assistance Act — Article 22-4 (Working conditions under reduced working hours for family care)

(1) No employer shall worsen the working conditions of an employee on reduced working hours under Article 22-3 on grounds of reduced working hours for family care, etc. except where such conditions are applied in proportion to the reduced working hours.

(2) The working conditions of an employee on reduced working hours under Article 22-3 (including the working hours after the reduction of working hours) shall be determined in writing between the employer and the employee.

(3) No employer may require an employee on reduced working hours under Article 22-3 to work overtime; provided, where the employee expressly requests to work overtime, the employer may have them work overtime for up to 12 hours per week.

(4) If average wages defined in subparagraph 6 of Article 2 of the Labor Standards Act are calculated with respect to an employee on reduced working hours, the period of reduced working hours shall be excluded from the period for calculating average wages.[This Article Added on Aug. 27, 2019]
