(1) Where a bareboat charterer uses a ship for voyage for a commercial transaction or other profit-making purpose, he/she shall have the same rights and obligations as a shipowner against a third party for matters concerning its use.
(2) In cases falling under paragraph (1), the preferential right arising in regard to the use of a ship shall have the same effect on a shipowner: Provided, That the same shall not apply when it is known that a person with the preferential right is contrary to a contract for such use.[This Article Wholly Amended by Act No. 8581, Aug. 3, 2007]
