Commercial Act — Article 833 (Partial Charter and Cancellation of Contracts before Departure, etc.)

상법 제833조

(1) A partial charterer or consignor may cancel or terminate a contract as referred to in Article 832 only where he/she cancels or terminates the contract jointly with another charterer and all the consignors.

(2) Except in cases falling under paragraph (1), when a partial charterer or consignor has cancelled or terminated a contract before departure, he/she shall pay the full amount of the freight.

(3) Where a partial charterer or consignor has loaded the whole or any portion of the cargo even before departure, he/she shall not cancel or terminate the contract without the consent of the other charterers and consignors.[This Article Wholly Amended by Act No. 8581, Aug. 3, 2007]
