(1) A person having a right of retention must keep the retained article with the care of a good manager.
(2) A person having a right of retention may not, without the consent of the debtor, use or lease the retained article nor pledge it as security; provided, this shall not apply to such use of the thing as necessary for its preservation.
(3) If a person having a right retention contravenes the provisions of the preceding two paragraphs, the debtor may demand the extinction of the right of retention.
