(1) If a person having chonsegwon does not use or take profit from the subject matter of chonsegwon according to the terms applied to the use thereof, or according to the character of the subject matter, the settlor of chonsegwon may claim the extinguishment of chonsegwon.
(2) In the case of the preceding paragraph, the settlor of chonsegwon may request the person having chonsegwon to restore the subject matter to its original condition or may demand compensation for loss in lieu thereof.
