Where a testamentary donee dies without effecting either an acceptance or a renunciation of the testamentary gift, his or her inheritor can effect an acceptance or a renunciation within the limits of his or her share of the inheritance; provided, if the testator has declared a different intention in his or her will, such intention shall prevail.
