(1) Where it is deemed necessary for the hearing of a case, taking into consideration impacts, etc. on industries, the presiding judge may have public organizations and other expert witnesses submit written opinions on the case at trial.
(2) A national agency or local government may submit a written opinion on a case at trial to the Intellectual Property Trial and Appeal Board with respect to matters related to the public interest.
(3) With respect to a written opinion submitted by an expert witness under paragraph (1) or (2), the presiding judge shall provide the parties with an opportunity to state their opinions orally or in writing.
(4) Matters necessary for submission of written opinions by expert witnesses under paragraph (1) or (2), such as expert witness selection, expenses, and matters to be observed, shall be prescribed by Ordinance of the Ministry of Trade, Industry and Energy.[This Article Newly Inserted on Sep. 14, 2023]
