(1) Every traffic safety educational institution shall employ traffic safety education instructors.
(2) Traffic safety education instructors referred to in paragraph (1) shall be any of the following:
1. Persons who hold certificates of qualifications as instructors for driving education, as delivered by the Commissioner General of the Korean National Police Agency pursuant to Article 106 (2);
2. Persons who have been engaged in administrative affairs or educational affairs involving road traffic for at least 2 years and who have received education for qualification as traffic safety education instructors prescribed by Presidential Decree.
(3) None of the following persons can become a traffic safety education instructor: <Amended on Feb. 13, 2024>

2. A person for whom 2 years have not elapsed since his or her imprisonment without labor or heavier punishment declared by a court for committing any of the following crimes was completely executed or exempted or who is under suspension of the execution:(a) A crime under Article 3 (1) of the Act on Special Cases concerning the Settlement of Traffic Accidents;(b) A crime under Articles 5-3, 5-11 (1), and 5-13 of the Act on the Aggravated Punishment of Specific Crimes;(c) A sexual crime defined in Article 2 of the Act on Special Cases concerning the Punishment of Sexual Crimes;(d) A sex offense against children or youth defined in subparagraph 2 of Article 2 of the Act on the Protection of Children and Youth against Sex Offenders;

4. A person who fails to obtain a driver's license that allows him or her to drive any motor vehicle, or who is a novice driver.
(4) No head of any traffic safety educational institution shall allow a person who is not a traffic safety education instructor to educate prospective drivers in traffic safety.
(5) When statutes or regulations governing roads and traffic are amended and it is deemed necessary to efficiently provide traffic safety education, the commissioner of a City/Do police agency may provide training and education for traffic safety education instructors, as prescribed by Presidential Decree. <Amended on Dec. 22, 2020>
(6) Where traffic safety education instructors shall undergo training and education pursuant to paragraph (5), the head of any traffic safety educational institution shall take measures to cause them to undergo such training and education where there is any unavoidable cause.[This Article Wholly Amended on Jun. 8, 2011]
