Road Traffic Act — Article 148-3 (Penalty provisions)

도로교통법 제148조의3

(1) Any person who dismantles or manipulates the ignition interlock device or undermines its utility by other means in violation of Article 50-3 (4) shall be punished by imprisonment with labor for not more than three years or by a fine not exceeding 30 million won.

(2) Any person who drives a motor vehicle, etc. with an ignition interlock device while aware that the device has been dismantled, manipulated, or its utility has been undermined, in violation of Article 50-3 (4), shall be punished by imprisonment with labor for not more than one year or by a fine not exceeding three million won.

(3) Any person who, on behalf of a person who has been granted a conditional driver's license with an ignition interlock device, blow into the device or otherwise fraudulently cause the device to start a motor vehicle equipped with an ignition interlock device so that the person may operate the motor vehicle, in violation of Article 50-3 (5), shall be punished by imprisonment for not more than one year or by a fine not exceeding three million won.[This Article Added on Oct. 24, 2023]
