(1) A person who makes an invention or his or her successor shall be entitled to a patent under this Act: Provided, That no employee of the Korean Intellectual Property Office or the Korean Intellectual Property Trial and Appeal Board is entitled to a patent while in service, except by inheritance or bequest.
(2) If at least two persons jointly make an invention, they are jointly entitled to a patent thereon.[This Article Wholly Amended on Jun. 11, 2014]
