Monopoly Regulation and Fair Trade Act — Article 86 (Enforcement fines)

독점규제 및 공정거래에 관한 법률 제86조

(1) If any business entity or trade association fails to comply with an order to submit a report, materials, or articles issued pursuant to Article 81(1)3 or (6), the Fair Trade Commission may issue the second order to submit the report, materials, or articles by the fixed deadline for enforcement, by the decision at a subcommittee meeting if such report, materials, or articles are deemed necessary to verify the violation of this Act; and may impose on a person who fails to comply with the second order an enforcement fine not exceeding 3/1,000 of the average daily sales prescribed by Presidential Decree per day from the date the deadline for enforcement passes; provided, an enforcement fine not exceeding two million won per day may be imposed from the date the deadline for enforcement passes where no sales have been made or it is impracticable to calculate the sales.

(2) Article 16(2) through (4) shall apply mutatis mutandis to the imposition, payment, collection, refund, etc. of enforcement fines. <Amended on Jan. 21, 2025>
