Labor Standards Act — Article 43-7 (Prohibition of Departure)

근로기준법 제43조의7

(1) Pursuant to Article 4 (3) of the Immigration Act, the Minister of Employment and Labor may request the Minister of Justice to prohibit the departure of business owners in arrears who are included in the publicly disclosed list under Article 43-2.

(2) When the Minister of Justice imposes a ban on departure based on the request under paragraph 1, he or she shall notify the Minister of Employment and Labor of the results through information and communications networks, etc.

(3) Where the grounds for prohibition of departure from the Republic of Korea cease to exist such as through the payment of overdue wages, the Minister of Employment and Labor shall immediately request the Minister of Justice to lift the prohibition.

(4) Except as provided in paragraphs (1) through (3), matters necessary for procedures for the prohibition of departure, the request to lift the prohibition, etc. shall be prescribed by Presidential Decree.[This Article Newly Inserted on Oct. 22, 2024][Enforcement Date: Oct. 23, 2025] Article 43-7
