(1) Criteria for the determination of penalties shall be prescribed by Decree of the Ministry of Justice.
(2) The Minister of Justice may exempt an immigration offender from the disposition of notice under Article 102(1) in consideration of his or her age and background, the motive for and consequences of the offense in question, capacity to bear a penalty, and other circumstances.[This Article Wholly Amended on May 14, 2010]
