Enforcement Decree of the Immigration Act — Article 80-12 (Subcommittee)

출입국관리법 시행령 제80조의12

(1) Subcommittees shall be established not more than 3, in consideration of the characteristics, specialized fields, etc. of matters to be deliberated, and shall perform the following duties:

1. Preliminary review and coordination of agenda items designated by the chairperson among agenda items to be submitted to the Immigration Detention Review Committee;

2. Specialized research and study on agenda items designated by the chairperson among agenda items to be submitted to the Immigration Detention Review Committee;

3. Other duties deemed necessary by the chairperson to be handled by the subcommittee.

(2) Each subcommittee shall be comprised of up to 5 members, including 1 chairperson of the subcommittee.

(3) The chairperson of a subcommittee shall be appointed from among the standing members under Article 66-6 (4) of the Act, and the members of a subcommittee shall be appointed by the chairperson from among the members of the Immigration Detention Review Committee who are not the standing members. In such cases, the chairperson and members of each subcommittee may concurrently serve as the chairperson and members of another subcommittee.

(4) Article 66-9 of the Act and Article 80-4 of this Decree shall apply mutatis mutandis the exclusion of, challenge to, or recusal of members of subcommittees. In such cases, "Immigration Detention Review Committee" shall be construed as "subcommittee," "chairperson" as "chairperson of a subcommittee," and "members" as "members of a subcommittee," respectively.[This Article Added on May 27, 2025]
