Enforcement Decree of the Commercial Act — Article 48 (Scope of aircraft excluded from application mutatis mutandis of provisions for carriage by air)

"Cases prescribed by Presidential Decree" in the proviso of Article 897 of the Act means where a State-owned or public airplane falls under any of the following categories: <Amended on Mar. 29, 2017>

1. An airplane for military forces, police, or customs;

2. An airplane used for a purpose specified in any item of subparagraph 1 of Article 2 of the Aviation Safety Act;

3. Any other airplane not used for profit-making, but for actual public use, such as an airplane for emergency or for human rescue.
