Customs Act — Article 233-2 (Establishment of Korea Institute of Origin Information)

(1) The Government shall establish the Korea Institute of Origin Information (hereinafter referred to as the “Institute”) to effectively perform the affairs necessary to collect, analyze and utilize origin information on goods exported or imported pursuant to this Act, the Act on Special Cases of the Customs Act for the Implementation of Free Trade Agreements and other treaties and agreements, etc., and to support verification thereof.

(2) The Institute shall be a corporation.

(3) The Government may contribute to or subsidize the Institute to cover the expenses incurred in operating the Institute and performing its affairs within the budget.

(4) The Institute shall perform the following affairs to achieve the purpose of its establishment:

1. Collecting, analyzing, and providing information on relevant systems, policies and their utilization with regard to free trade agreements and origin;

2. Matters concerning the construction and operation of a system for managing origin information on goods imported or exported;

3. Matters concerning support for the certification of approved exporters, origin verification, etc.;

4. Projects necessary for education on free trade agreements and origin and nurturing of professional human resources;

5. Projects entrusted by the Government, a local government, a public agency, etc. with respect to free trade agreement and origin;

6. Other projects incidental to the business affairs specified in subparagraphs 1 through 5 and projects necessary for achieving the purpose of the establishment of the Institute.

(5) For the Institute, except as provided in this Act and the Act on Operation of Public Agencies, the provisions of the Civil Act governing an incorporated foundation shall apply mutatis mutandis.

(6) No person, other than the Institute under this Act, shall use the name, the Korea Institute of Origin Information, or any similar name.

(7) The Commissioner of the Korea Customs Service shall direct and supervise the affairs of the Institute.[This Article Wholly Amended on Dec. 31, 2022]
