(1) When rendering a sentence of a fine or minor fine, the court shall simultaneously determine and declare a substitute term of lockup at a workhouse when payment of such fine or minor fine is not made in full. <Amended on Dec. 8, 2020>
(2) A substitute term of lockup at a workhouse of at least 300 days shall be specified for a fine imposed by a sentence, if the fine is at least 100 million won but less than 500 million won; a substitute term of lockup of at least 500 days, if the fine is at least 500 million won but less than five billion won; or a substitute term of lockup of at least 1,000 days, if the fine is at least five billion won. <Newly Inserted on May 14, 2014; Dec. 8, 2020>[Title Amended on Dec. 8, 2020]
