(1) A person who, administering another's business, receives property or obtains pecuniary advantage from a third party or aids and abets a third person to receive property or obtain pecuniary advantage, in response to an illegal solicitation concerning his or her duty, shall be punished by imprisonment with labor for not more than five years or by a fine not exceeding ten million won. <Amended on May 29, 2016>
(2) A person who gives the property or pecuniary advantage specified in paragraph (1) shall be punished by imprisonment with labor for not more than two years or by a fine not exceeding five million won. <Amended on Dec. 8, 2020>
(3) The property specified in paragraph (1) that has been obtained by the offender or a third party having knowledge of its nature shall be confiscated.
