Criminal Act — Article 129 (Acceptance of Bribe and Advance Acceptance)

형법 제129조

(1) A public official or an arbitrator who receives, demands or promises to accept a bribe in connection with his or her duties, shall be punished by imprisonment with labor for not more than five years or suspension of qualifications for not more than ten years.

(2) If a person who is to become a public official or an arbitrator receives, demands or promises to accept a bribe in response to a solicitation, in connection with the duty which he or she is to perform and he or she actually becomes a public official or arbitrator, imprisonment with labor for not more than three years or suspension of qualifications for not more than seven years shall be imposed.[Interpreting a ‘public official’ under Article 129 (1) of the Criminal Act (Act No. 293 enacted on Sept. 18, 1953) to include members commissioned from among members of Jeju Self-Governing Province integrated deliberative committee on impact assessment under Article 299 (2) of the Special Act on the Establishment of Jeju Self-Governing Province and the Development of Free International City (referring to the previous version of such Act amended on Jul. 27, 2007 as Act No. 8566) is in violation of the Constitution according to the decision of limited unconstitutionality (2011Hun-Ba117) by the Constitutional Court made on December, 27, 2012.]
