(1) If a person who performs or assists in activities concerning judgment, prosecution, police, or other functions involving the restraint of the human body, arrests or imprisons another by abusing his or her official authority, he or she shall be punished by imprisonment with labor for not more than seven years and suspension of qualifications for not more than ten years.
(2) Attempts to commit the crimes specified in the preceding paragraph shall be punished.
