(1) Articles 23, 28 through 34, 35-2, 35-4, 35-5, 36, and 37 shall apply mutatis mutandis to the use of database which is the object of the rights of database producers. <Amended on Dec. 2, 2011; Nov. 26, 2019>
(2) In either of the following cases, a person may reproduce, distribute, broadcast, or interactively transmit the whole or considerable parts of database; provided, the same shall not apply where it is in conflict with the normal exploitation of the relevant database: <Amended on May 18, 2021; Aug. 8, 2023>
1. Where the database is used for education, scholarship or research; provided, the same shall not apply to the case aiming at profit-making;
2. Where the database is used for the news reporting.
