(1) If the seller of a claim warrants the solvency of the obligor, he or she is presumed to have warranted his or her solvency at the time the contract was entered.
(2) If the seller of a claim which is not yet due warrants the solvency of the obligor, he or she is presumed to have warranted his or her solvency at the time when the claim becomes due.
