(1) Where a party to a contract has agreed therein to effect an act of performance in favor of a third person, the person may demand such act of performance directly from the obligor.
(2) In the case of the preceding paragraph the right of the third person shall come into existence from the time when he or she declares to the obligor his intention to accept the benefit of the contract.
