If the obligee refuses to accept performance or is unable to accept it, the person effecting performance may relieve himself or herself of his or her obligation by depositing the subject matter of performance for the obligee. The same shall apply where the obligee cannot be ascertained without any negligence on the part of the person effecting performance.
