(1) An obligee may, in order to preserve his or her claim, exercise the rights belonging to the obligor; provided, this shall not apply to such rights as are strictly personal to the obligor.
(2) Before a claim becomes due, the obligee cannot exercise the rights mentioned in the preceding paragraph without the court's permission; provided, this shall not apply to an act of preservation.
