(1) The owner of land may, to the extent that it is necessary for the construction or repairs of walls or buildings in or near the boundary, demand use of the adjoining land; provided, he or she may not enter the dwelling house of the neighbor without his consent.
(2) In the case mentioned in the preceding paragraph, if the neighbor sustains any damages he may claim compensation for it.
