(1) A manifestation of intention may be rescinded where there is a mistake in a material part of the contents of a juristic act; provided, the same shall not apply where such mistake results from gross negligence on the part of the person manifesting the intention.
(2) The nullity of a declaration of intention as mentioned in the preceding paragraph cannot be set up against a third person acting in good faith.
