(1) Where an unspecified item has become the subject of a testamentary gift, the person charged with the testamentary gift shall assume the same liability with respect to the warranty as that of a seller.
(2) In the case mentioned in paragraph (1), if any defect exists in the object, the person charged with the testamentary gift shall substitute an item free from any defect for the object.
