(1) A manifestation of intention shall be effective even if the person manifesting the intention knows that it is not his or her true intention; provided, it shall be void if the other party knew or could have known that the intention expressed was not the true intention of the person manifesting it.
(2) The nullity of a declaration of intention as mentioned in the preceding paragraph cannot be set up against a third person acting in good faith.
