(1) The share in inheritance of a person who becomes an heir in place of a person who dies pursuant to Article 1001 or fails to become an heir pursuant to Article 1004 or 1004-2 shall be based on the share in inheritance of the person who dies or fails to become an heir.
(2) In the case referred to in paragraph (1), where there are 2 or more lineal descendants of the person who dies or fails to become an heir pursuant to Article 1004 or 1004-2, their shares in inheritance shall be determined pursuant to Article 1009 within the limit of the share in inheritance of the person who dies or fails to become an heir.
