(1) If there exist such inheritors as provided in Article 1000(1)1 and 2, the spouse of the inheritee becomes a co-inheritor, in the same order as the said inheritor. If there exists no inheritor, the spouse becomes the sole inheritor. <Amended on Jan. 13, 1990>
(2) In the case referred to in Article 1001, the spouse of a person who dies before the commencement of inheritance shall become a co-inheritor with the inheritor under that Article in the same order of inheritance, and where there is no such inheritor, the spouse shall become the sole inheritor. <Amended on Jan. 13, 1990; Mar. 17, 2026>[Title Amended on Jan. 13, 1990]
