Act on the Protection and Use of Location Information — Article 9-2 (Reporting on location-based service business of micro enterprises)

위치정보의 보호 및 이용 등에 관한 법률 제9조의2

(1) Notwithstanding Article 9 (1), if a person that is either a micro enterprise, defined in Article 2 of the Framework Act on Micro Enterprises, or a self-employed creative enterprise, defined in Article 2 of the Act on the Fostering of Self-Employed Creative Enterprises, (hereinafter referred to as "micro enterprise or self-employed creative enterprise") intends to engage in the location-based service business, the person may do so without filing a report under Article 9 (1); provided, if the person intends to continue to engage in the location-based service business even 1 month after the commencement of the business shall report the following matters to the Korea Media and Communications Commission within 1 month from the commencement date of the business, as prescribed by Presidential Decree: <Amended on Feb. 4, 2020; Oct. 1, 2025>

1. Company name;

2. Location of the principal office;

3. Type and details of business.

(2) Any person for whom 1 year has not passed since the person was ordered to discontinue business operations under Article 13 (1) (if the person is a corporation, including its representative) shall be prohibited from reporting another location-based service business under paragraph (1). <Amended on Jun. 9, 2020>

(3) If a person that has filed a report under the proviso of paragraph (1) changes either of the following, the person shall report the change to the Korea Media and Communications Commission within 1 month from the date of change, as prescribed by Presidential Decree: <Amended on Oct. 1, 2025>

1. Company name;

2. Location of the principal office.

(4) If a person that has commenced a location-based service business in accordance with the main clause of paragraph (1) or a person who has filed a report in accordance with the proviso of that paragraph ceases to be a micro enterprise or self-employed creative enterprise, the person shall file a report with the Korea Media and Communications Commission to supplement matters necessary for reporting under Article 9 (1), within 1 month from the date the relevant event occurs, as prescribed by Presidential Decree. <Amended on Oct. 1, 2025>[This Article Added on Apr. 17, 2018]
